By creating an account, booking a tutoring session, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. These Terms constitute a legally binding agreement between you and Blixaroneodhik. If you are using our services on behalf of a minor, you represent that you have the authority to bind that minor to these Terms.
Blixaroneodhik provides online tutoring services in various subjects including languages such as Spanish, French, Mandarin, and Japanese, music instruction covering various instruments and music theory, design education including graphic design and digital illustration, and photography training encompassing composition, lighting, and post-processing techniques.
Our services include one-on-one video tutoring sessions, personalized learning plans and curriculum development, educational materials and resources, progress tracking and assessment, email support between sessions, and certificates of completion. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.
To access certain features of our services, you may be required to create an account. When creating an account, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, false, or misleading, or if you violate these Terms.
When you book a tutoring package or session, you agree to pay the fees specified at the time of booking. All prices are listed in New Zealand dollars and include applicable taxes unless otherwise stated. Payment must be received before your first tutoring session begins.
We accept various payment methods including bank transfer, credit card, and approved online payment platforms. By providing payment information, you represent and warrant that you have the legal right to use the payment method and authorize us to charge the applicable fees.
Fees are non-refundable except as expressly provided in our Return Policy. We reserve the right to change our pricing at any time, but price changes will not affect bookings already confirmed and paid for.
Once you have purchased a tutoring package, you may schedule sessions at mutually convenient times with your assigned tutor. We strive to accommodate your scheduling preferences, but availability may vary based on tutor schedules and demand.
If you need to cancel or reschedule a session, you must provide at least 24 hours notice. Cancellations made with less than 24 hours notice may result in forfeiture of that session. We understand that emergencies occur and will consider exceptions on a case-by-case basis.
We reserve the right to cancel or reschedule sessions due to tutor illness, technical difficulties, or other unforeseen circumstances. In such cases, we will make reasonable efforts to reschedule the session at no additional cost to you.
When using our services, you agree to conduct yourself in a respectful and appropriate manner. You agree not to use our services to harass, abuse, threaten, or intimidate tutors or other users, transmit any content that is unlawful, harmful, threatening, abusive, defamatory, vulgar, obscene, or otherwise objectionable, infringe upon the intellectual property rights of others, transmit viruses or malicious code, or attempt to gain unauthorized access to our systems or networks.
You agree to attend scheduled sessions on time and prepared to learn. Repeated no-shows or disruptive behavior may result in termination of your access to our services without refund.
All content on our website and provided through our services, including text, graphics, logos, images, videos, audio clips, and software, is the property of Blixaroneodhik or its content suppliers and is protected by New Zealand and international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to access and use our services and educational materials solely for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any of our content except as necessary for your personal learning purposes.
Any materials you submit to us, including practice work, feedback, or suggestions, become our property, and we may use them for any purpose without compensation to you.
While we strive to provide high-quality educational content and instruction, we make no guarantees regarding specific learning outcomes or results. Your progress depends on various factors including your effort, practice, natural aptitude, and engagement with the material.

To use our online tutoring services, you must have access to a computer, tablet, or smartphone with a camera and microphone, a stable internet connection with sufficient bandwidth for video conferencing, and a compatible web browser or application as specified by us.
You are responsible for ensuring that your equipment and internet connection meet these requirements. We are not responsible for technical difficulties on your end that prevent you from accessing or using our services, and such difficulties do not entitle you to a refund.

By using our services, you consent to our collection and use of your information as described in the Privacy Policy.
We may record tutoring sessions for quality assurance and training purposes. By participating in sessions, you consent to such recording. Recordings are stored securely and used only for internal purposes unless you provide explicit consent for other uses.
To the fullest extent permitted by law, Blixaroneodhik, its directors, employees, tutors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or other intangible losses, resulting from your access to or use of or inability to access or use our services, any conduct or content of any third party on our services, or any unauthorized access, use, or alteration of your transmissions or content.
Our total liability to you for all claims arising from or related to our services shall not exceed the amount you paid to us in the six months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Blixaroneodhik, its directors, employees, tutors, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees, including reasonable attorneys' fees, arising from your use of our services, your violation of these Terms, or your violation of any rights of another party.

If a dispute cannot be resolved through negotiation, you agree to submit to the exclusive jurisdiction of the courts located in Auckland, New Zealand. You waive any objection to venue in such courts and any claim that such courts are an inconvenient forum.

You may terminate your account at any time by contacting us. Upon termination by either party, any unused sessions in prepaid packages may be subject to our Return Policy. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property rights, limitation of liability, and dispute resolution provisions.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent.
These Terms, together with our Privacy Policy, Cookies Policy, and Return Policy, constitute the entire agreement between you and Blixaroneodhik regarding your use of our services and supersede all prior agreements and understandings, whether written or oral.
